Taking Driver Improvement Before Your Court Date
Virginia DMV specifically states that if you have not yet been to court, you are not considered court-directed.
A driver who chooses to complete Driver Improvement before court may therefore be attending voluntarily, depending on the circumstances.
The court still determines what credit, if any, it gives the course for the underlying court matter.
If a Court Has Already Ordered the Course
If the court has already directed you to complete Driver Improvement, your attendance is court required, not voluntary.
In that situation, the court determines whether safe-driving points are awarded and the appropriate court documentation must be provided to the clinic.
